Hicks was becoming a liability for (former Australian PM, John) Howard, who was under pressure by the public and some lawmakers to return Hicks to Australia. Howard told Cheney that Hicks had to be charged with something because there weren’t any laws in Australia for which he could be prosecuted if the US government simply repatriated him.
