{"id":260,"date":"2015-05-21T19:39:50","date_gmt":"2015-05-21T19:39:50","guid":{"rendered":"https:\/\/melangedmaculateme.wordpress.com\/2015\/05\/21\/court-rules-that-cia-can-keep-secret-the\/"},"modified":"2023-07-28T16:25:13","modified_gmt":"2023-07-28T20:25:13","slug":"court-rules-that-cia-can-keep-secret-the","status":"publish","type":"post","link":"https:\/\/melange.dmaculate.me\/home\/2015\/05\/21\/court-rules-that-cia-can-keep-secret-the\/","title":{"rendered":"Court Rules That CIA Can Keep Secret the 7,000-Page Senate Torture Report"},"content":{"rendered":"<p><a href=\"http:\/\/www.matthewaid.com\/post\/119542146536\/court-rules-that-cia-can-keep-secret-the\" class=\"tumblr_blog\" target=\"_blank\" rel=\"noopener\">matthewaid<\/a>:<\/p>\n<blockquote>\n<p>May 21, 2015<\/p>\n<p><b>Court sides with CIA, \u2018torture\u2019 reports to stay secret<\/b><\/p>\n<p>Michael Doyle<\/p>\n<p>McClatchy News<\/p>\n<p>May 21, 2015<\/p>\n<p>\n \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<br \/>\n \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<br \/>\n \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0WASHINGTON \u2014 The CIA can keep<br \/>\nsecret a nearly 7,000-page Senate report on harsh interrogation methods,<br \/>\n as well as an internal agency review, a federal judge has ruled.<\/p>\n<p>The<br \/>\n complete 6,963-page report compiled by the Senate Select Committee on<br \/>\nIntelligence, and the related \u201cPanetta review,\u201d are exempt from the<br \/>\ndictates of the Freedom of Information Act, U.S. District Judge James E.<br \/>\n Boasberg concluded.<\/p>\n<p>Though noting that \u201cthis case is no slam dunk for the government,\u201d Boasberg in \u00a0<a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2013cv1870-52\" target=\"_blank\" rel=\"noopener\">his 26-page decision Wednesday<\/a><br \/>\n rejected the ACLU\u2019s arguments for disclosure. The Senate committee<br \/>\nreport, he reasoned, remained a document under congressional control,<br \/>\nand Congress made sure to exempt itself from FOIA.<\/p>\n<p>\u201cCongress has<br \/>\nundoubted authority to keep its records secret, authority rooted in the<br \/>\nConstitution, longstanding practice, and current congressional rules,\u201d<br \/>\nBoasberg stated.<\/p>\n<p>The fact that the Senate intelligence panel had<br \/>\nforwarded a copy of the full report to the CIA, Boasberg added, \u201cshould<br \/>\nnot be readily interpreted to suggest more wholesale abdication of<br \/>\ncontrol.\u201d <\/p>\n<p>Hina Shamsi, director of the ACLU National Security Project, voiced disappointment in the ruling.<\/p>\n<p>\u201cThe<br \/>\n direct, contemporaneous evidence shows that the full torture report is<br \/>\nsubject to the FOIA because Congress sent it to the executive branch<br \/>\nwith instructions that it be broadly used to ensure torture never<br \/>\nhappens again,\u201d Shamsi said in a statement. \u201cThe Senate\u2019s landmark<br \/>\ninvestigation into a dark period in our nation\u2019s history should not stay<br \/>\n behind closed government doors, but needs to see the light of day.\u201d<\/p>\n<p>But the current Senate committee chairman, Sen. Richard Burr, R-N.C., said he was pleased.<\/p>\n<p>Further<br \/>\n release of this highly classified document will compromise the national<br \/>\n security of the United States and needlessly put Americans lives at<br \/>\nrisk,\u201d Burr said.<\/p>\n<p>The Senate committee \u00a0<a href=\"http:\/\/www.mcclatchydc.com\/2014\/10\/16\/243669\/senates-inquiry-into-cia-torture.html\" target=\"_blank\" rel=\"noopener\">released a summary <\/a>of the \u00a0<a href=\"http:\/\/www.mcclatchydc.com\/2014\/04\/11\/224085\/cias-use-of-harsh-interrogation.html\" target=\"_blank\" rel=\"noopener\">$40 million report<\/a> last December, following years of back-and-forth.<\/p>\n<p>In<br \/>\n its a June 2009 letter to the CIA, the Senate committee specified that<br \/>\nthe documents it generated during its investigation \u201cremain<br \/>\ncongressional records in their entirety and disposition\u201d and that<br \/>\n\u201ccontrol over these records, even after the completion of the<br \/>\nCommittee\u2019s review,\u201d would \u201clie exclusively with the Committee.\u201d<\/p>\n<p>\u201cAt<br \/>\n the end of the day,\u201d Boasberg wrote, \u201cthe ACLU asks the court to<br \/>\ninterject itself into a high-profile conversation that has been carried<br \/>\nout in a thoughtful and careful way by the other two branches of<br \/>\ngovernment.
