The case that was shunned by the Supreme Court on Monday, Saleh v. Titan Corporation, was an important attempt to extend accountability from the military to the contractors who make up such a huge part of America\u2019s post-9\/11 war machine, and who, unlike their official military counterparts, appear to be as much beyond the law as the senior administration officials \u2014 and their lawyers \u2014 who implemented, approved and oversaw every aspect of the \u201cWar on Terror\u201d that should have shocked the conscience \u2014 involving torture, \u201cextraordinary rendition,\u201d secret prisons and the miseries of arbitrary detention at Guant\u00e1namo. As Human Rights First explained, \u201cArmy investigations implicated at least five private contractors in similar crimes,\u201d although \u201cno contractor was ever charged.\u201d
